I have been in U.S since 2013 on H1B visa, this time I got stuck in admin process and below are the timelines. 20-Jul-2023 - Drop box appointment submit the passports along with dependents 25-Jul-2023 - Case created and approved for H1 and H4 28-Jul-2023 - H4 Visa for children's issued 30-Jul-2023 - Received children's passports 28-Aug-2023 - Mine and my spouse visa status changed to refused 30-Aug-2023 - Got an email from Chennai consulate that visa application for myself and my spouse is refused for admin processing, No documents requested 27-Oct-2023 - Reached out the U.S congressmen to open up inquiry with dept of state or Chennai consulate but did not help much. - Multiple emails sent to Chennai consulate and same update, case date did not change at all - 180 days crossed and every time when I check with Chennai consulate, got the standard response that my case in admin process and cannot predict when it will be completed. 01-Feb-2024 - Hired Goldstein Immigration to file a Mandamus lawsuit 16-Feb-2024 - Draft mandamus lawsuit was prepared 20-Feb-2024 - Mandamus lawsuit filed 04-Mar-2024 - summons reached all the defendants 04-Mar-2024 - Court has set a timeframe for which the defendants must respond to the compliant by 03-May-2024 08-Mar-2024 - Case last updated field changed to today's date. 13-Mar-2024 - case status changed from refused to Admin processing 14-Mar-2024 - Again changed to refused 15-Mar-2024 - got an email from Chennai consulate to submit passports, same day submitted at Bangalore dropbox. 25-Mar-2024 - Status changed to Approved 26-Mar-2024 - Status changed to Issued If your case is pending more than 180 days and the case is not moving at all, please do not waste your time, go ahead and file a mandamus lawsuit Goldstein Immigration lawyers help us to get our visa stamped and we are planning to return back to U.S soon.
