But Mr Davis who met me at the Maywood court house was very friendly and made me feel that things would work out. i got no penalty or anything from the Judge I believe because of his effort.     My experience with Avi Fagan was nothing short of a nightmare. At the time, I was being held on a no bond probation violation for a revoked driving charge, and as such, incarcerated pending a status hearing, which bond would then be discussed. My partner called 10 separate lawyers, and was given the opportunity to set up a free, 30 minute consultation with Avi Fagan. During the 39 minute phone consultation, Avi Fagan asked questions about the case, which my partner not being an attorney obviously had only basic information to give to him. She was clear with attorney Fagan that given the circumstances, the most important outcome from the preliminary hearing be that bond be set. The case had no violent offenses, no attached dui or drug implications, and therefore I would be eligible for the presiding judge to consider bond. It was allegedly implied by attorney Avi Fagan in this consultation not to worry, this is his bread and butter (referring to his alleged expertise in criminal traffic representation experience) and was expressed because I was not making the decision to hire Avi Fagan if the defendant decides after court he doesnt wish to be represented further by myself, you have the opportunity to fire me (Avi Fagan) and a refund of your $2000.00 up front fee could be returned. The next morning, Avi Fagan filed an appearance and appeared via zoom to represent me in a preliminary hearing. Mr. Fagan announced his leave to file appearance, and rather than moving to set bond, said nothing while the judge moved to set a court date 30 days out from that day! I felt helpless not to blurt out bond! Which then prompted Avi Fagan to ask the judge if he wanted to discuss bond? The judge said he saw no request for bond and that at the moment, there is no bond set. The sole remedy being sought was bond. After not getting the result, instead of asking for a sooner date, Avi Fagan agreed to the 30 day period between now and the next court date, and the case was passed meaning without any other action, on a non violent, no injury, drug or alcohol related case, without any victim, Id be incarcerated for 30 days. For most individuals, this would mean loss of employment, and would be a major financial and emotional disaster for any attorneys client and their family. That evening was the first opportunity I had to speak directly and freely to Avi Fagan I had, albeit a 3-way call from cook county jail. I asked what happened? What is the plan of action going forward? The response from Avi Fagan was I will prepare for your upcoming court date, and hopefully garner a new response for bond. I was livid! Does this individual understand what it would mean to a client to be held on no bond in a situation like this for an entire month? No game plan, no motions to request bond, no conversation of alternative options such as home monitoring or some sort of anything other than just sit tight for 30 days. Thinking about my family being unable to pay their bills, losing employment based on unnecessary incarceration, and have no way to accomplish responsibility were too heavy to believe this was the correct attorney to trust. I fired him that evening. I hired another attorney the following day, he has since filed a motion for bond, which was granted. The new attorney completed a deal to reduce the felony conviction originally entered in my case to a misdemeanor and time served. If Id have stuck with the course of action on the table from Avi Fagan I would STILL be incarcerated. My partner requested a refund which of the $2k they collected, $500 was agreed to be returned. Upon completed my case, I contacted Avi to ask why what appeared to be an hour of work that garnered no positive result was worth $1500 and ask for a substantial refund. He told me that he could send an itemized bill but that would cost me the time it took to create. Is this who you want to trust your freedom with?

A bond review was requested as promised, and the Judge refused to address bond until a later date - that's up to the Judge. Of course there was no promise of a particular result or your money back, that would be an ethical violation for any Illinois lawyer handling a criminal case, and in fact is spelled out in the written legal fee agreement signed on your behalf by your partner. A partial refund was requested, an amount agreed upon, and then that amount was immediately refunded. Incidentally, you need to have further conversation with your current attorney, as you clearly do not understand the current status of your case, which is not at all as you described.
