Kathleen is an extremely thorough and concise in her legal advice to Boards. I worked with her as a Board member and now as a Board President and I am very impressed with her prompt response times regularly and she is always prepared. I am a 75-year-old attorney who currently practices law solely for family and friends.
I recently was involved with a complicated case involving a mixed-use condominium where the Association, controlled by a small faction of resident owners, employed exceptionally egregious tactics to target and harm the smaller group of commercial owners.
After years of repeated efforts of trying to amicably resolve the issues, I along with other commercial condo owners were compelled to take legal action against the Association to put a stop to the procedural and financial attacks, and to rectify the improper charges billed to the commercial owners.
To do that we hired Kathleen Profitt. It was the best decision we could ever have made. Kathleens experience and in-depth knowledge of condominium and nonprofit governance laws, combined with her litigation background, were instrumental in achieving justice for the disenfranchised commercial owners.
The residential defendants had an abundance of what seemed like unlimited resources from insurance and association funds to fight us, while the commercial owners had to spend all our own money in trying to set matters right. The legal fees we had to incur just to require the lawful governance of the condominium were considerable, to say the least.
With the aid of the Associations insurance defense team, the defendants fought very aggressively, and tried every move in the book. Nevertheless, we ultimately prevailed in large part because of the superb legal foundation Kathleen Profitt provided us.
In fighting for our rights, Kathleen was extremely intelligent, savvy, and knew the law. And when she didn't know a particular aspect of the law, she thoroughly researched it in order to sort those legal details out as well.
She was tenacious and focused, and a hardworking, law-and-fact-driven attorney, who knew what she was doing and did not back down in the face of the oppositions intimidation tactics. She particularly shined at a highly contentious Annual Meeting, where she faced attacks that most lawyers would not have had the fortitude to withstand. She was never fooled by any of the shenanigans of the opposition. And most importantly she listened to us, as in most situations the client knows the facts better than anyone.
Kathleen knew when to push and when to back off, and ultimately, as a result of the fine legal groundwork that she laid for us, we obtained a highly favorable result on all of the critical terms at issue, and we recovered almost all of our legal fees from the defendants, something that is very, very rare.
I can unequivocally and wholeheartedly recommend Kathleen Profitt, as I found her to be one of the very best attorneys that I have ever dealt with in my many years of practicing law and as a businessman.
