Janet, I have consulted with multiple professionals in various fields and all have concluded LPW was not at fault in this incidence. I also made a claim with my insurance company who agreed that it was not the fault of LPW and refused the claim. I have consulted with other apartments and hoa managers and they have all stated that gate damage is typically paid for by their own insurance and some thought your HOA should be responsible for any damage to my trailer which I did not pursue.I am including below a copy of my emailed response to your request for payment:Valerie,Thank you for the video and response.  I am sorry but based on the video and some things I will outline here, I do not feel Lightning Pressure Washing is liable for any damages to the Lake Mariana Reserve gate.I travel through community gates all the time. There are not many (none that I can recall)  that operate each side independently.  The gates that do operate independently for in and out typically have a median of some sort in between.  All the swinging gates like yours that I travel through swing both sides (in and out) at once.  This is a very unique and honestly ill advised gate.There was no signage present advising a visitor as to the operation of the gate.There were no lane lines indicating a vehicle needed to stay specifically in a certain spot to be able to pass theough safely.The video shows the driver waiting until the gate was completely open and barely turning the wheel.  The video shows the vehicle travelling straight through. Not making a turn too early or anything of the sort.  The video also shows the gate beginning to close after the vehicle began to travel through it.The video shows the gate closing on the trailer, not the trailer hitting the gate.One of the HOA board members told me this had never happened before.  That does not mean the gate is setup properly.  There should be safeties and sensors in place to prevent the gate from hitting a vehicle.  Where were they?  Why did they not work?This incidence has exposed a fault in the design and operation of the gate.  We will not accept responsibility for the damages.   No expected safety precautions such as signs, warnings, lane lines were taken by the community.  Lightning Pressure Washing will not be paying for the damages to the HOA gate.  Thanks for your time.Mike KindleHere is the response from the insurance company following making a claim:I agree with your whole stance Mr. Kindle I even roundtabled this file with a few other experienced adjusters as well and we do not see where we are liab for the damages to the gate as it struck your trailer not the other way around. No gate was torn off as you have written, and my vehicle/trailer did not hit the gate.
