    Initially I thought she was amazing until we figured out it was all a money grab , my brother was barred from the U.S. and the only way that he could visit was a waiver . We met with her and she was very nice and essentially lied about what could be done to fix his status we were overjoyed and my brother paid $1300 for her services. When he attended his interview at the U.S. Embassy they asked him why he was there and he said because my lawyer advised him. They told him if you know the law you would know that if you get barred the only way to re enter is a waiver sorry. I contacted my original lawyer and this is what he said. Serge, Good to hear from you. Sorry to hear about the problems with your younger brother. To enter the US a Canadian needs to meet the standards for admission. Unfortunately 20 years ago you brother got caught in a lie or some form of misrepresentation. Border Control had the authority to turn him around and send him back to Canada, which they did, writing him up, and subjecting him to 5 year bar from entering the US for 5 years. Even after the 5 years you brother still has the record of having lied or misrepresented some fact at the border, which makes him inadmissible, unless he can secure a waiver. Regrettably the immigration law doesn't forgive misrepresentation in the absence of a waiver, and a waiver is tough to get. Waivers are expensive, and in the case of a waiver for a simple visit, expire at the end of the visit. A more permanent waiver could be obtained if your brother sought one in connection with obtaining a green card. It sounds to me like it makes a lot more sense for you and your family to visit your brother in Canada, rather than have him visit you in the US. If you want to try to overcome this bar on his re-entry I would suggest that he pursue a green card through a US relative, a wife, a child, a parent? As part of that process the waiver could be processed, assuming that there is a qualifying relative to support the waiver request - and that relative must show extreme hardship if he is not allowed to remain here in the US. Assuming he gets that waiver, and his green card is approved, then all is forgiven, and the bar will not impact him when he comes and goes from the US presenting his green card. However, as a green card holder he needs to spend significant time here in the US, and needs to make the US his home. Otherwise, he's going to continue to have this problem as an "immigration violator" who committed fraud or misrepresentation, and has no way to achieve forgiveness. So as you can see it was clearly a money grab stay far away from this lawyer !!!!!!!

Good to hear from you. Sorry to hear about the problems with your younger brother.

Let's correct the record, you were charged $1,000.00 for a visitor visa which is the going rate, any additional fee was based on a Consulate charge. Misrepresentation was not disclosed at client intake. He did not qualify for an immediate visa. I understand you are frustrated, but Department of State, USCIS & DHS take misrepresentation seriously. If you think $1,000.00 makes me rich and that I was all about money, then you are sadly mistaken. Unfortunately, he will not qualify for a waiver, unless there's a Material change in his circumstances. We wish you well.
