I am glad that everything we handled for your case went well. Based on your post, your car lender decided to pick up your car because you did not reaffirm the loan. Your problem with your car lender is a common issue in bankruptcy. There are almost 5000 banks in the US and each bank has their own procedures with dealing with car loans after bankruptcy. Your bank decided to pick up the car instead of letting you keep it and continue under the terms of your loan. I am assuming you were current on all payments as they would take it if you were late and missing payments. I can not speak to the specifics of your case beyond what you have posted but I can tell you how we handle this issue generally. In general, as your attorney, I can not recommend signing back up for a car loan that is generally on bad terms (high interest rates, upside down on the car loan, etc.). When a creditor sends a reaffirmation to us, we forward it to you for your approval and then you can go in front of the Judge for their approval. Since you did not reaffirm on your car, one of two things happened- 1. your bank did not send us the paperwork to reaffirm the loan (we can not create these documents as the bank has all of your payment information) or 2. you chose to not reaffirm the loan. I would have highly recommended the later option. Losing the car, while not an easy situation, is generally better for you in the long run. Most people have better credit after filing bankruptcy than they did before. It may take some time, but if your bank chooses not to work with you- I always recommend my clients shop around and buy the minimum vehicle they need and pay it off as soon as possible and then in a year or two they can get the better interest rates once their credit improves. I am sorry you are having to deal with this situation but I am glad that you received your discharge and removed all of the debt from your life.
